What Happens During a Typical Traffic Stop?

What Happens During a Typical Traffic Stop?

During a typical traffic stop, the police try to develop probable cause to arrest you, search your vehicle, or issue you a citation. Here is the usual sequence of events during a traffic stop. Getting Pulled Over First, the police officer or sheriff “pulls over” someone’s vehicle by flashing the police car’s lights, turning on the siren, and/or speaking over the loudspeaker. At this point the driver should pull over to the side of the road, or risk appearing like he is going to flee the scene. The police officer pulls over too, usually parking behind the driver’s vehicle. Then the officer...

Yet More Problems with Breathalyzers: Latest Updates

Yet More Problems with Breathalyzers: Latest Updates

Yet more problems with breathalyzers have emerged in recent news reports from Massachusetts. The stories reveal two different, but sadly common, issues facing defense lawyers and their clients with DUI charges. Improper Calibration of Breathalyzers First, improper calibration of breathalyzers dating all the way back to 2011 was discovered by a group of defense lawyers starting back in 2015. The lawyers learned that the specific model of breathalyzer used by the police was not calibrated to the proper range, affecting the expected margin of error for the devices. This range is narrower than in other states, and the police had not...

Should You Take a Breathalyzer Test at a Traffic Stop?

Should You Take a Breathalyzer Test at a Traffic Stop?

When you are pulled over in a traffic stop by a police officer, you may wonder if you should take a breathalyzer test or if you should refuse the test. This is a tricky question that depends on your feelings about the consequences of refusal. Implied Consent Law For many years, Oklahoma has had an implied consent law for refusing a BAC (blood alcohol concentration) test such as a breathalyzer or blood test. If you are driving a vehicle on public roads or if you are in actual physical control of such a vehicle, then you impliedly give consent to take a...

Revealing the Flaws in Breathalyzer Testing Procedures in Court

Revealing the Flaws in Breathalyzer Testing Procedures in Court

As DUI defense attorneys know, drivers may have excellent arguments that breathalyzer testing results should be excluded from consideration in court. Flaws in administering and interpreting breath tests abound. Which Kinds of Flaws in Breath Testing Can Be Shown in Court? The list of potential flaws in breath testing for DUI is long: Incorrect directions were given to a driver who takes a breathalyzer; Miscalibrated breathalyzer device used; Broken or old breathalyzer device used; Maintenance procedures for the breathalyzer were not followed; The specific model of breathalyzer has a fatal design flaw; Law enforcement broke the chain of custody for the results; ...

Random Breath Testing Devices: What You Need to Know

Random Breath Testing Devices: What You Need to Know

If you pled guilty to a DUI or took a plea deal, the court may require you to do random breath testing using a special device. The device is similar to a breathalyzer that you use at home or at a probation supervisor’s office. Like an ignition interlock device or alcohol monitoring bracelet, it detects alcohol usage in an effort to stop repeat DUIs. How Does a Random Breath Testing Device Work? These devices are very similar to a breathalyzer, except that they often have identity verification features. For example, some random breath testing devices have voice recognition, facial recognition, or picture...

How Do Ignition Interlock Devices Work?

How Do Ignition Interlock Devices Work?

A sentence for driving under the influence may require a driver to use an ignition interlock device. This device is often unfamiliar to people who have never been convicted of a DUI. Before you agree to a plea bargain or begin your sentence, learn what you can expect when using the interlock device. An ignition interlock device resembles a breathalyzer for your car. It has a small tube that you breathe into, connected to an electronic box. When you get the ignition interlock installed, the technician will hook it up to your car’s ignition system. Each time you start the car,...

Alcohol Ankle Monitors: Are They Legal and How Do They Work?

Alcohol Ankle Monitors: Are They Legal and How Do They Work?

Similar to ignition interlock devices, alcohol ankle monitors help courts keep an eye on people who committed DUIs. You may wonder if they are legal in Oklahoma, and how they work. If an ankle monitor could be part of your DUI sentence, you probably have many questions. Is an alcohol monitoring bracelet legal in Oklahoma? The laws in Oklahoma do not specifically mention alcohol ankle monitors or bracelets. However, use of these devices has become increasingly popular. In the past, the court could order that a person convicted of DUI not consume any alcohol. To enforce the court order, a parole officer...

Breathalyzer Technology: Still Unreliable?

Breathalyzer Technology: Still Unreliable?

Doubts about breathalyzer accuracy continue to circulate in the DUI defense community and have led to successful court strategies for defendants. There are two main ways that defense attorneys challenge breathalyzer results: by questioning calibration and maintenance procedures and rules, and by questioning whether the machines, even properly calibrated, produce accurate results. Courts have repeatedly found problems with the way police departments maintain breathalyzers and with the rules governing calibration and maintenance. See our previous blogs on this topic. Further, courts continue to order manufacturers to release source code for breathalyzer devices to defense attorneys. A recent case from Washington state...

New Report Recommends 0.05 BAC Limit

A new report encourages states to adopt a 0.05 blood alcohol concentration limit for drivers accused of driving under the influence. In a study sponsored by the National Highway Traffic Safety Administration, a non-profit group called the National Academies of Sciences, Engineering, and Medicine examined drunk driving fatalities over the past 30 years and the costs associated with enforcement of DUI laws. The National Academies concluded that lowering the BAC limit – making it easier for drivers to be arrested – and changing a host of strategies for combatting drunk driving would lower fatalities. This latest report is far from the...

Ignition Interlock Devices and Personal Breathalyzers

Ignition Interlock Devices and Personal Breathalyzers

In the state’s quest to prevent drunk driving and punish drivers who violate the law, ignition interlock devices as DUI prevention have become increasingly popular. At the same time, drivers looking to avoid the consequences of a DUI often use personal breathalyzer devices. Oklahoma drivers who have their licenses revoked after a DUI arrest and do not seek an administrative hearing may obtain a modified license to drive. One condition of the modified license is installation of an ignition interlock device on the car or cars they drive. In addition, many drivers receive an ignition interlock requirement as part of a...
